Please read these Terms and Conditions ("Terms") before using dunchess.com and related services (the "Services") operated by Dunchess ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Acceptance and Eligibility
By creating an account or using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. You must be at least 13 years of age to use the Services. If you are under 18, you should use the Services only with the consent of a parent or guardian. You represent that you have the right and authority to enter into these Terms.
2. Account and Security
You may need to create an account to use certain features. You agree to provide accurate and complete registration information and to keep it up to date. You are responsible for maintaining the confidentiality of your password and for all activity under your account. You must notify us promptly of any unauthorized use of your account. We are not liable for any loss or damage arising from unauthorized use of your account.
One account is intended for one person. You may not share your account, sell it, transfer it, or allow others to use it. We may suspend or terminate your account if we believe you have violated these Terms or for other reasons we deem appropriate.
3. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party rights.
- Harass, abuse, threaten, or harm other users or any person.
- Impersonate another person or entity, or misrepresent your affiliation.
- Cheat, manipulate, or exploit the Services (e.g., using bots or unauthorized software to gain an unfair advantage in games).
- Interfere with or disrupt the Services, servers, or networks.
- Attempt to gain unauthorized access to the Services, other accounts, or our systems.
- Transmit viruses, malware, or other harmful code.
- Collect or harvest other users' data without consent.
- Use the Services for any commercial purpose without our prior written consent.
We reserve the right to remove content, suspend or terminate accounts, and take other action we deem necessary to enforce these rules and protect the Services and our users.
4. Your Content and Game Data
You retain ownership of content you submit (e.g., profile information, in-game chat). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and process that content as needed to provide and improve the Services (e.g., showing your username and avatar on leaderboards, in game history, and in replays).
Game data (e.g., moves, results, ratings) is generated through use of the Services. We may store, display, and use this data to operate the Services (e.g., leaderboards, statistics, replays). Some of this data may be visible to other users or the public.
You represent that you have the right to submit any content you provide and that it does not infringe any third-party rights.
5. Our Intellectual Property
The Services, including the website, software, design, text, graphics, logos, and other materials (excluding your content), are owned by us or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, revocable license to access and use the Services for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Services or our content without our prior written consent.
6. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE (AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.
8. Indemnification
You agree to indemnify, defend, and hold harmless Dunchess and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any law or third-party rights, or (d) any content you submit or your conduct toward other users.
9. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice. You may stop using the Services at any time. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive (e.g., ownership, disclaimer, limitation of liability, indemnity, governing law) will survive termination.
10. Changes to the Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the updated Terms. For material changes, we may provide additional notice (e.g., email or in-app). If you do not agree to the new Terms, you must stop using the Services.
11. General
Governing law: These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that state.
Entire agreement: These Terms, together with our Privacy Policy and any other policies we reference, constitute the entire agreement between you and us regarding the Services.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
No waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
